FAQ
Initial Assessment: Is What Happened Truly Malpractice?
Not every negative outcome automatically constitutes malpractice. When we assess a file, we do not look only at the outcome. We evaluate the entire process. What was promised to you, which procedures were performed, what information was given throughout the process, the content of the medical records, the nature of the damage that occurred, and whether the result was compatible with reasonable expectations are all considered together.
In particular, aesthetic operations, hair transplantation, dental implants, zirconium crowns, and similar procedures are, under Turkish law, often regarded as falling within the scope of a contract for work. This means that the doctor or clinic is obliged not only to exercise due care, but also to produce a result consistent with what was promised. Accordingly, when determining whether the file truly contains a medically and legally actionable error, we assess the matter not only from a medical perspective, but also within the framework of legal liability.
What Should Be Done Immediately After the Incident?
When a patient believes that they have suffered harm, the most important priority is always health. First, any necessary medical intervention must be obtained. Immediately thereafter, it becomes critically important to preserve the evidence so that your legal rights are protected. Treatment invoices, payment records, WhatsApp correspondence, emails, before and after photographs, hospital or clinic records, prescriptions, reports, and, where available, second medical opinions all play a crucial role at this stage.
Many patients initially focus only on physical recovery and therefore delay the legal process, with the result that certain evidence may be lost over time. However, acting early is important both for preserving evidence and for avoiding the expiry of limitation periods or procedural deadlines. At this stage, we determine on your behalf which documents are important, what constitutes evidence, and which materials will strengthen the litigation strategy.
